According to law enforcement officials, the case of a New York man discovered deαd after being choked on a subway train will probably be heard by a grand jury next week.
A grand jury will decide whether to file criminal charges against the subway rider accused of placing 30-year-old Jordan Neely in a chokehold on May 1 to detain him after witnesses claimed he was acting strangely.
According to CBS New York, 24-year-old Marine veteran Daniel Penny was detained by NYC police for questioning before being let go after being caught on camera choking Neely.
In a statement posted by his attorneys on Friday night, Penny expressed his condolences to Neely’s family and friends. According to the investigation, Neely allegedly had “a documented history of violent and erratic behavior, the apparent result of ongoing and untreated mental illness.”
Also stated was that Penny “never intended to harm Mr. Neely and could not have foreseen his untimely death.”
In New York, the Department of the Chief Medical Examiner determined that Neely’s deαth was a homicide on Wednesday.

The video shows the 24-year-old man holding Neely in a chokehold for a considerable time.
Neely is seen lying motionless on the ground while two other riders attempt but ultimately fail to control his arms.
On the train, Neely behaved wildly, hurling rubbish and yelling at passengers.
The 24-year-old attempted to intervene and defuse the situation, but physical violence ensued. Who was the aggressor? Neely is said to have been choked by the younger man, who then instructed onlookers to call 911.
